Terms of Service

These Terms govern your use of the Thanks in Kind website and store (the "Site") and any cards you create, send or buy through it. By using the Site or making a purchase, you agree to these Terms. The store is hosted on Shopify.
1. Our service
Thanks in Kind lets you create thank-you cards. Digital cards are free to make and share by link, text, email or social apps. Printed cards are a paid service: we print your card and mail it to the addresses you provide, using a third-party printing and mailing fulfillment partner.
2. Your content
You are responsible for the names, messages, photos and addresses you add. Only upload photos you have the right to use, and only send cards to people you have a legitimate reason to contact. Do not use the Site to send anything unlawful, hateful, harassing or misleading. You keep ownership of your content and give us permission to use it only as needed to create, display, print and deliver your cards. We may refuse or remove content that breaks these Terms.
3. Writing and translation help
The Site can suggest note wording and translate notes into other languages. Suggestions and translations are provided as a convenience and may not be perfect. Please review your note before you send or order it.
4. Mailed card orders
Before checkout you confirm that every name, address and note is correct. Orders can be cancelled free of charge within 1 hour of ordering. After that, cards go to print and cannot be changed. Delivery times depend on the postal service and are estimates, not guarantees. Printed colors may vary slightly from what you see on screen.
5. Prices and payment
Prices are in USD and may change without notice. Payment is processed by Shopify and its payment partners. Applicable sales taxes may be added at checkout. We may refuse or cancel any order, for example in cases of suspected fraud or pricing errors, and we will refund you if we do.
6. Refunds and reprints
Refunds, reprints, cancellations and lost mail are governed by our Refund Policy, which is part of these Terms. In short, if we make a mistake (a print defect, wrong text, an address error on our side or damage), we will reprint your card or give you a full refund. If a customer provides a typo or wrong address, we offer a corrected resend at 50% off. Requests go to gratitude@thanksinkind.com within 30 days.
7. Fair use
Free tools have usage limits to keep them available for everyone. You may not use the Site for any unlawful purpose, attempt to interfere with its security, automate or scrape it, or get around its usage limits.
8. Intellectual property
The Site, its designs, built-in pictures, fonts and layouts are owned by Thanks in Kind or its licensors. You may use them to make and send cards through the Site, but not resell or redistribute them separately.
9. Third-party services
We rely on third parties such as Shopify, payment processors, our printing and mailing fulfillment partner and the postal service. Their terms apply to their services, and we are not responsible for them.
10. Disclaimer and limitation of liability
The Site and cards are provided "as is." To the fullest extent permitted by law, Thanks in Kind is not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid for the order involved.
11. Indemnity
You agree to indemnify Thanks in Kind against claims arising from your breach of these Terms or misuse of the Site.
12. Governing law
These Terms are governed by the laws of Georgia, United States, except where your local consumer law says otherwise.
